Stephen Bailey, 28, was arrested early Friday at his home in the 15000 block of Cassiano Road. He is the primary suspect in the fatal shooting of Mark Anthony Ortega, 42, a local Tejano performer whose bullet-riddled body was found Sept. 18, 2011 in a shower at a hangar next to his home.
The men had a history of disagreements prior to the shooting, authorities have said.
At the time of his release, First Assistant District Attorney Cliff Herberg said the case was not ready to present to a grand jury. Authorities had no witnesses or fingerprints and still were waiting on the results of DNA and trace evidence analysis.
A murder indictment for Bailey was issued Wednesday, two days before he was re-arrested.
Although Herberg declined to specify Friday what new evidence has been obtained, he said prosecutors “believe we now have sufficient evidence to prosecute the case in court.”
“We only get one chance,” Herberg said, explaining that double jeopardy would have made it risky to take it to a jury too soon. “We've got to get all the evidence we can before we go into court.”
Bailey has denied any involvement in the Sept. 18 Ortega's killing, according to a 2011 arrest warrant affidavit.
He remained silent and did not respond to requests for comment from a reporter as deputies escorted him to the city magistrate's office early Friday.
